In a landmark ruling, the Supreme Court has reinstated two women judges, Aditi Kumar Sharma and Sarita Chaudhary, who were unfairly dismissed from the Madhya Pradesh State Judicial Service. The decision brings long-overdue justice to these women, whose careers were cut short due to circumstances beyond their control—illness, family crises, and personal hardships that should have warranted understanding rather than punishment.
 
The bench, led by Justices BV Nagarathna and N Kotiswar Singh, took a firm stance against the arbitrary termination, pointing out glaring inconsistencies in the judges’ performance records. “The High Court report does not show consistent poor performance of judges and it speaks otherwise. There are inherent contradictions in the ACRs... Opportunity had to be given before termination. Thus, termination is punitive, arbitrary, and illegal,” the bench declared.
 
What makes this case particularly poignant is the insensitivity displayed toward the struggles of these judges—one had to battle COVID-19 and a miscarriage, while the other was coping with a cancer diagnosis in her family. Instead of support, they were met with dismissal. The Court did not just overturn their termination; it sent a strong message about the need for a judiciary that is not only fair in its judgments but also compassionate towards those who uphold the law.
 
Justice Nagarathna’s remarks resonate deeply in a world where women still struggle for equal footing in many professions, including the judiciary. “Greater representation of women in the judiciary will increase the quality of justice being rendered and also promote gender equality in broader ways,” she stated.
 
Beyond legalities, this case shines a light on the unseen battles women in the judiciary face—pregnancy, menstruation-related health concerns, and the emotional toll of balancing professional and personal responsibilities.
