Supreme Court Halts Uttar Pradesh and Uttarakhand Orders on Eateries During Kanwar Yatra

On Monday, the Supreme Court issued an interim stay on the recent directives from the Uttar Pradesh and Uttarakhand governments, which mandated eateries along the Kanwar Yatra route to publicly display the names of their owners. The controversial orders had raised fears of heightening communal tensions during the religious pilgrimage.

A bench comprising Justices Hrishikesh Roy and S.V.N. Bhatti questioned the legitimacy and origin of these directives during the proceedings. Trinamool Congress MP Mahua Moitra, who filed a petition challenging the state orders, was represented by senior advocate Abhishek Singhvi.

Singhvi argued that the orders amounted to "exclusion by identity" and violated constitutional guarantees of equality and non-discrimination. He raised doubts about the official status of these directives, asking, "Has any formal order been passed by the state governments, or is this a veiled attempt to target certain communities?"

The Supreme Court's decision to intervene brings temporary relief amid concerns about the potential for increased communal strife during the Kanwar Yatra.
