In a bold move to strengthen environmental justice in India, prominent lawyer and environmental activist Akash Vashishtha has reached out to Chief Justice DY Chandrachud with a compelling proposal. Vashishtha has urged the establishment of dedicated "green benches" in each of the country's high courts. This initiative aims to speed up the handling of environmental cases, which have become increasingly urgent given the escalating ecological crises we face.
In his letter, Vashishtha underscored the pressing nature of the issue by citing recent climate disasters and severe environmental damage. While the National Green Tribunal (NGT) has played a crucial role in addressing environmental disputes, he believes that its impact is limited by the constraints of the National Green Tribunal Act of 2010.
Vashishtha pointed out that the legal recourse available under Article 226 of the Indian Constitution offers a broader scope for citizens to seek compensation for environmental harm affecting both public and private interests. He argues that the current framework under the NGT Act falls short of fully addressing these environmental grievances.
To tackle this challenge effectively, Vashishtha advocates for the creation of specialized "green benches" in all 25 high courts across India. This proposal is inspired by the successful introduction of similar benches in the Supreme Court and aims to provide a more robust and permanent solution to environmental and climate-related issues.
