Two district judges from Himachal Pradesh, Chirag Bhanu Singh and Arvind Malhotra, have approached the Supreme Court with complaints about unfair treatment in the judicial appointment process by their states High Court Collegium. They contend that their qualifications and seniority were disregarded, and advice from the Supreme Court Collegium, led by Chief Justice D.Y. Chandrachud, was ignored. The controversy began when the Supreme Court Collegium sent the names of Singh and Malhotra back to the High Court for reconsideration. Despite this directive, the judges claim that the High Court Collegium did not properly follow through. They allege that the process overlooked a letter from the Union Law Minister, which called for a reassessment of their qualifications. Instead, the High Court Collegium is accused of deliberately sidelining them in favor of less qualified, junior judicial officers. Legal Challenge and Supreme Courts Involvement The judges have filed a joint writ petition demanding that the High Court Collegium re-evaluate their nominations in line with the Supreme Court Collegiums proposal from January 4. They argue that the High Court Collegiums recent actions, which they claim dismissed their names without proper review, were unconstitutional and violated established norms for judicial appointment.
