In a significant move to protect legal professionals, the Karnataka government has officially implemented the Karnataka Prohibition of Violence against Advocates Act 2023 (KPVA Act) as of June 10, 2024. This groundbreaking legislation is designed to protect advocates from violence, enabling them to carry out their duties without fear of intimidation or harassment.
The KPVA Act, introduced by Karnataka's Law and Parliamentary Affairs Minister, HK Patil, on December 11, 2023, quickly passed through the Karnataka Legislative Assembly the following day. After receiving the governor's assent on March 20, 2024, the law is now in effect, demonstrating a strong commitment to safeguarding legal practitioners in the state.
The need for this law arises from the recognition of the vulnerabilities faced by advocates, including the risk of malicious and frivolous prosecution by opposing parties. Such challenges not only affect individual lawyers but also impede the broader administration of justice.
Inspired by international standards, the KPVA Act aligns with the "Basic Principles on the Role of Lawyers," adopted at the Eighth United Nations Congress on the Prevention of Crime and the Treatment of Offenders in Havana, Cuba. Clauses 16 and 17 of this declaration provide explicit guarantees for the functioning of lawyers, emphasizing their right to operate without interference, the freedom to travel and consult with clients, and protection from punitive measures related to their professional activities.
This legislation marks a significant step forward in ensuring that legal professionals in Karnataka can work in a safe and supportive environment, reinforcing the state's commitment to upholding justice and the rule of law.
