The incident occurred on May 6, 2013, when Suseelan, driving under the influence, collided with a motorcycle on the Thadambattuthazham-Kannadikkal road in Kozhikode. Shaji Kumar, the motorcyclist, was accompanied by his wife, Nisha M., and their son, Abhishek Narayanan. The collision, caused by Suseelan allegedly driving on the wrong side, resulted in Shaji's death and severe injuries to Nisha and Abhishek.

The core question was whether Suseelan's actions amounted to culpable homicide or merely negligent driving. His defense argued that speed alone doesn't equate to rash driving, citing a Supreme Court precedent.
